Welcome to Neurosculpting®. These Terms of Service (“Terms”) are a binding agreement between you and Ripple Effect LLC, doing business as the Neurosculpting® Institute (“Neurosculpting,” “we,” “us,” or “our”). They govern your use of www.neurosculpting.com and any related websites, online courses, learning paths, memberships, live online sessions, in-person classes, events, retreats, certification and facilitator programs, digital downloads, communities, and other products and services we offer (together, the “Services”).
By accessing the Services, creating an account, or making a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
IMPORTANT: ALL SALES ARE FINAL. Due to the nature of our digital products and live programs, we do not offer refunds, credits, or exchanges for any purchase, except for the event credit described in Section 10 or where applicable law requires otherwise. Please read Section 6 before you buy.
1. Eligibility
You must be at least 18 years old to create an account or purchase from us. By using the Services, you confirm that you are 18 or older and able to enter into a binding contract.
2. Educational Services, Not Medical or Mental Health Care
Neurosculpting® is an educational and wellness practice that combines meditation, mindfulness, and brain-based training. Our courses, meditations, breathwork practices, classes, events, and other content are provided for educational and personal growth purposes only.
- The Services are not medical care, psychotherapy, counseling, or a substitute for diagnosis or treatment by a licensed health care or mental health professional.
- Using the Services does not create a doctor-patient or therapist-client relationship with Neurosculpting, Lisa Wimberger, or any instructor or facilitator.
- Always consult a qualified professional about any physical or mental health condition, and before stopping or changing any treatment or medication.
- Completing a Neurosculpting® training or certification does not make anyone a licensed clinician. Facilitators listed in our directory are independent practitioners and are responsible for their own services, licensing, and conduct.
If you are in crisis or thinking about harming yourself, call or text 988 (the Suicide and Crisis Lifeline in the U.S.) or call 911. Do not rely on the Services in an emergency.
3. Clinical Therapy Services
Any one-on-one therapy offered through the Neurosculpting® Institute is provided by an independently licensed clinician and is governed by that clinician’s separate intake documents, informed consent, and Notice of Privacy Practices, not by these Terms. Information you share in clinical therapy is handled under those documents and applicable health privacy law.
4. Practices That Involve Your Body: Assumption of Risk
Some Services include breathwork, movement, yoga, guided visualization, and practices that may bring up strong emotions or memories. Certain breathing techniques can cause lightheadedness, tingling, or changes in heart rate. You participate voluntarily and at your own risk. Please consult your physician before participating if you are pregnant, or have a heart condition, high or low blood pressure, epilepsy or a seizure disorder, a respiratory condition, a history of psychosis or dissociation, or any other medical or psychiatric condition. Stop any practice that feels unsafe, and seek appropriate care. To the fullest extent permitted by law, you accept the risks of participating.
5. Your Account
You are responsible for keeping your login credentials confidential and for all activity under your account. Accounts are for one person only. You may not share your login or give anyone else access to purchased content. Please contact us right away if you believe your account has been used without your permission.
6. Purchases and Our All Sales Final Policy
Prices are listed in U.S. dollars. Where taxes apply, they are shown at checkout. Payments are processed securely by our payment providers. By completing a purchase, you authorize us to charge your selected payment method for the total amount shown, including any scheduled installment or renewal charges described at checkout.
All sales are final. Because our programs grant immediate access to digital content, reserve limited space in live programs, and involve preparation and costs we incur on your behalf, we do not issue refunds, partial refunds, prorated refunds, credits, or exchanges for any purchase. This applies to all products and services, including:
- Online courses, learning paths, bundles, meditations, recordings, and digital downloads;
- Memberships and subscriptions, including the current billing period after you cancel;
- Payment plans and minimum-commitment programs;
- Live online sessions, seminars, workshops, classes, and challenges;
- In-person classes, events, summits, and retreats, including VIP and upgraded tickets;
- Certification, facilitator, and professional training programs; and
- Coaching, cohort, and group programs.
This policy applies regardless of whether you access, complete, or attend the program, and regardless of changes in your schedule, circumstances, or satisfaction. Nothing in these Terms limits any right you have under applicable law that cannot be waived by agreement.
Purchases are personal to you and may not be transferred, resold, or shared, except that an event or retreat ticket may be transferred to another participant where the offer allows it, by notifying us in writing before the event.
7. Payment Plans and Minimum Commitments
A payment plan is a way to pay for a program over time, not a subscription you can stop. If you choose a payment plan, you are purchasing the full program and commit to making every scheduled payment shown at checkout until the full price is paid. Stopping or cancelling a payment plan does not cancel the remaining payments, and no installment is refundable. If an offer states a minimum commitment period, you agree to pay for the entire minimum period. If a scheduled payment fails, we may retry the charge and may suspend your access until your account is current. We may refer unpaid balances for collection as permitted by law.
8. Memberships, Subscriptions, and Automatic Renewal
MindMakers Membership
The MindMakers Membership is available with monthly or annual billing. Current pricing and what is included are described on the membership page and shown at checkout before you join. Membership benefits currently include live online sessions with Lisa Wimberger (held by video conference, typically twice a month), access to the member community, a new downloadable meditation each month, and a member discount on eligible Neurosculpting® courses, workshops, and content. We may adjust the schedule, format, or specific benefits of the membership over time, and we will give members advance notice of any material change.
When your membership ends, your access to live member sessions, the member community, and member discounts ends. Monthly meditations you downloaded while a member are yours to keep for personal use under Section 12. Courses and programs you bought separately, including those bought with a member discount, are not affected by cancelling your membership and stay available under Section 9.
Automatic renewal
Memberships and other subscriptions renew automatically at the end of each billing period (monthly or yearly, as you choose at checkout) and charge the payment method on file at the then-current price until you cancel. The price, billing frequency, and any minimum commitment are shown at checkout before you subscribe.
- How to cancel: You can cancel online at any time from your customer dashboard, or by sending us a message through our contact form.
- When cancellation takes effect: Cancellation stops future renewal charges. You keep access to membership content through the end of the billing period you already paid for. Consistent with Section 6, we do not refund the current period.
- Courses you keep after cancelling: When an offer states that courses are included for you to keep (for example, a course bundle earned by completing a minimum commitment), you keep access to those courses after you cancel, under Section 9, as long as every required payment has been made.
- Price changes: If we change a subscription price or make a material change to a subscription, we will notify you in advance by email, and you may cancel before the change takes effect.
- Renewal reminders: For subscriptions with a billing period of one year or longer, we will send a reminder before the renewal charge.
9. Course and Content Access
Unless an offer states otherwise, access to purchased online content continues for as long as we make that program available online. We may update, reorganize, or improve course content over time. If we permanently retire a program, we will give you reasonable advance notice so you can complete or review it. Some offers, such as time-limited challenges or cohort programs, include access for a stated period only, as described on the offer page.
10. Live Online Sessions, In-Person Classes, Events, and Retreats
- Schedule changes: Dates, times, instructors, venues, and agendas may change. If we reschedule, your registration carries over to the new date. If we cancel a session or event entirely and do not reschedule it, we will offer you a credit toward a future Neurosculpting® program of equal value.
- Missed sessions: If you miss a live session, any available recording will be provided only if the offer includes recordings. Missing a session does not entitle you to a refund or credit.
- Recordings and photos: Live online sessions and some events may be recorded. By attending, you consent to being recorded and to our use of those recordings for program delivery, and we will ask for your separate permission before using your image or voice in marketing.
- Travel and lodging: Unless an offer states otherwise, you are responsible for your own travel, lodging, and related costs. We are not responsible for travel costs if an event changes or if you cannot attend.
- Venue access: Our Denver institute is on the second floor of a walk-up building with no elevator. Please contact us before purchasing if you have accessibility questions.
- Conduct: We may remove anyone whose behavior is disruptive, unsafe, or disrespectful to others, without refund.
11. Certification and Facilitator Programs
Certification and facilitator programs have their own requirements, which are described in program materials and any separate agreement you sign. Enrolling does not guarantee certification. You may use the Neurosculpting® name, marks, or methods to offer services to others only as expressly permitted by a current written facilitator or licensing agreement with us.
12. Intellectual Property and Your License
All content in the Services, including courses, videos, audio, meditations, scripts, worksheets, text, graphics, and the Neurosculpting® name and logos, is owned by us or our licensors and is protected by copyright, trademark, and other laws. Neurosculpting® is a registered trademark.
When you purchase or access content, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use it for your own personal, non-commercial learning. You may not copy, download (except where we provide a download option), record, reproduce, distribute, publicly perform, sell, teach, or create derivative works from our content, or use it to train artificial intelligence models, without our prior written permission.
13. Community Spaces and Your Content
If you post comments, questions, or other content in a community space, live session chat, or group program, you keep ownership of it and grant us a non-exclusive, royalty-free license to host and display it as part of the Services. Please share only what you are comfortable having other members see, and respect the confidentiality of what others share. You agree not to post anything unlawful, harassing, hateful, misleading, or infringing, or any spam or advertising. We may remove content or suspend access that violates these Terms.
14. Testimonials and Results
Experiences vary from person to person. Testimonials reflect individual experiences and are not a guarantee or prediction of the results you will have. We do not promise any specific outcome from using the Services.
15. Affiliate Program
If you join our affiliate program, your participation is also governed by the affiliate program terms presented when you apply.
16. Communications
By creating an account or making a purchase, you agree that we may send you transactional emails about your purchases, access, and account. If you opt in to marketing emails, you can unsubscribe at any time using the link in any email.
17. Third-Party Services and Links
The Services may rely on or link to third-party services, such as payment processors, video platforms, and video-conferencing tools. We are not responsible for third-party services, and your use of them may be subject to their own terms and privacy policies.
18. Chargebacks
If you have a problem with a charge, please contact us first through our contact form so we can help. If you dispute a charge for a purchase you authorized, we may suspend your access to the Services while the dispute is pending and may provide the payment processor with records of your purchase, your agreement to these Terms, and your use of the Services.
19. Termination
We may suspend or end your access to the Services if you violate these Terms, share your account or our content, or act in a way that harms other participants or our business. Termination for these reasons does not entitle you to a refund. Sections that by their nature should survive termination will survive, including Sections 6, 7, 12, and 20 through 24.
20. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE ANY PARTICULAR RESULT.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEUROSCULPTING AND ITS OWNERS, EMPLOYEES, INSTRUCTORS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
22. Indemnification
You agree to defend, indemnify, and hold harmless Neurosculpting and its owners, employees, instructors, and contractors from any claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the Services or our content.
23. Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. Any dispute arising from these Terms or the Services will be resolved exclusively in the state or federal courts located in Denver, Colorado, and you consent to the jurisdiction of those courts.
24. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy and any program-specific terms or agreements you accept, are the entire agreement between you and us about the Services. If program-specific terms conflict with these Terms, the program-specific terms control for that program. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
25. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and change the “Last updated” date above. Material changes will not apply to purchases completed before the change. Your continued use of the Services after an update means you accept the updated Terms.
